These Terms of Service (“Terms”) govern your access to and use of Accessibility-Checking.com (the “Service”), operated by [Your Company Name] (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
By creating an account, accessing, or using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Accessibility-Checking.com provides automated web accessibility testing tools that scan websites for compliance with WCAG 2.0, 2.1, 2.2, ADA, Section 508, and other accessibility standards. The Service generates reports identifying accessibility issues and provides remediation guidance. We may modify, suspend, or discontinue any aspect of the Service at any time without notice.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.
We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. You may delete your account at any time through account settings. Upon termination, your right to use the Service immediately ceases.
You agree NOT to:

The Service, including all content, features, software, designs, graphics, and trademarks, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
You retain ownership of any content you submit to the Service (e.g., websites scanned, user feedback). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide the Service and improve our algorithms.
If you provide feedback, suggestions, or ideas about the Service, we may use them without compensation or obligation to you.
IMPORTANT: The Service provides automated accessibility testing and guidance but does not constitute legal advice. Compliance with accessibility laws (ADA, Section 508, etc.) requires professional legal interpretation. We recommend consulting with accessibility experts and legal counsel to ensure full compliance.
While we strive for accuracy, automated testing has limitations. The Service may not detect all accessibility issues, and some reported issues may be false positives. We do not guarantee that using the Service will result in full WCAG or legal compliance. Manual testing and expert review are recommended.
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure access to the Service. We may experience downtime for maintenance, updates, or technical issues.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Accessibility-Checking.com, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) violation of these Terms, (c) violation of any third-party rights, or (d) content you submit to the Service.
The Service may integrate with or link to third-party services (e.g., payment processors, analytics providers). We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Before filing a claim, you agree to contact us at support@accessibility-checking.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 30 days.
If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration will take place in [Your Jurisdiction]. Each party will bear its own costs, except as awarded by the arbitrator.
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles. Any disputes not subject to arbitration will be brought exclusively in the courts of [Your Jurisdiction].
We may modify these Terms at any time by posting updated Terms on this page with a new “Last Updated” date. Material changes will be communicated via email or prominent notice. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, discontinue use of the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Accessibility-Checking.com regarding the Service and supersede all prior agreements.
